DPO Fitness Terms of Use

Version 1.1, effective 2026-10-12.

Who we are

DPO Fitness ("the app") is an iPhone app for beginner strength training. It is made and run by Ari Garboos ("we", "us"). These terms are an agreement between you and us, effective 2026-10-12. By creating an account or using the app, you agree to them. If you do not agree, do not use the app.

Eligibility

You must be 18 or older to use the app. The app is not for children, and we do not knowingly collect information from anyone under 18. If we learn that a user is under 18, we close the account and delete its data.

Beta status

The app is in a test phase ("beta"), distributed through Apple's TestFlight to invited testers. During the beta:

We may end the beta at any time. If you send us feedback, we may use it to improve the app without owing you anything for it.

Not medical advice

The app is a general fitness tool. It is not medical care, and it does not diagnose, treat or prevent any condition. Nothing in the app is medical advice, including the program, its explanations and the coach. Check with your doctor before you start and before you make any medical decision. The disclaimer and the pain-stop rule you accept during onboarding are part of these terms.

Assumption of risk

Strength training carries a risk of injury, from strains and joint problems to, rarely, serious medical events. You decide whether to do each exercise, the load you actually use and when you stop. You agree to:

To the extent the law allows, you accept these risks. This section does not excuse us from responsibility for our own gross negligence or willful misconduct, or for anything else the law does not allow us to exclude.

The AI coach

The app includes a coach powered by artificial intelligence: a large language model provided by Anthropic. When you use the coach, you are talking to AI, not to a person.

Your content

You own what you put into the app: your profile, logs, ratings, notes and messages ("your content"). You give us permission to store, process and display your content only to run the app for you, which includes passing it to the service providers the privacy policy names. We do not sell your content or use it for advertising. You are responsible for what you write, so do not put other people's personal information into notes or messages.

Acceptable use

Do not:

We may suspend or close an account that breaks these rules.

Privacy

The privacy policy (privacy policy) explains what we collect, why, who processes it, how long we keep it and how to delete it. The health-data handling rule (summarized in the privacy policy's Health and fitness data section) sets stricter limits on health-adjacent data such as age, weight, pain flags, ratings and session logs: it is never sold, never used for advertising or marketing, and shared only with the processors the policy names.

Subscriptions and payments

This section applies only after the beta, when a paid tier launches. There is no charge during the beta.

When it applies: subscriptions are bought and billed through Apple, under Apple's terms. The price, the length of any free trial and the renewal period are shown before you buy. A subscription renews automatically unless you turn off auto-renew in your Apple account settings at least 24 hours before the current period ends. We never see or store your payment details. Apple handles refunds.

Account deletion and termination

You can delete your account at any time in Settings > Delete account. Deletion removes your account and your data as the privacy policy describes. You can first export your data in Settings > Export my data.

We may suspend or close your account if you break these terms, if the law requires it, or if we end the service. If we end the service, we will tell you in the app and, where we can, give you time to export your data. The sections on medical advice, assumption of risk, disclaimers, limitation of liability and governing law continue to apply after your account closes.

Disclaimers

The app is provided "as is" and "as available". To the extent the law allows, we make no promise that the app will be accurate, uninterrupted, error-free or suited to your goals, and we disclaim implied warranties, including merchantability, fitness for a particular purpose and non-infringement. Results depend on you and vary.

Limitation of liability

To the extent the law allows:

These limits do not apply to liability that the law does not allow us to limit, including liability for fraud, willful injury, gross negligence or violations of law. Some places do not allow these limits, so they may not apply to you.

Governing law

These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Disputes go to the state or federal courts in the State of California, unless the law where you live gives you the right to bring a claim where you live.

Changes to these terms

We may update these terms. We will show the new version in the app, with its effective date, before it applies to you. If a change is material, we will ask you to accept it, and if you do not, you can export your data and delete your account. We store which version you accepted and when.
